Health Care
Gammage & Burnham is one of the predominant health care firms in Arizona. We represent more than 40 hospitals statewide including Banner Health, St. Joseph’s Hospital and Medical Center, Phoenix Children’s Hospital, University Medical Center, Flagstaff Medical Center, Lincoln Health Resources, Scottsdale Healthcare, Sun Health, Vanguard Health System, Tucson Medical Center, Yuma Regional Medical Center and Carondelet Health Network. Gammage & Burnham also represents individual physicians, physician groups and other providers along the continuum of care including specialty providers, health care professionals and statewide associations of providers in various contexts, such as procurement, contracts, compliance, licensing, rulemaking and reimbursement. Our clients also include businesses that provide services to persons with developmental disabilities, substance abuse problems, and behavioral disorders. A major aspect of the firm’s health care practice is its work related to health care reimbursement. Our attorneys particularly emphasize reimbursement associated with government and commercial payers, including the Arizona Health Care Cost Containment System (Arizona’s Medicaid program, also known as “AHCCCS”), and Medicare. As part of this practice, Gammage & Burnham has negotiated multi-million dollar workout agreements and settlements, and successfully litigated against the AHCCCS Administration and State of Arizona. We have also successfully challenged various AHCCCS reimbursement methodologies. Gammage & Burnham’s health care practice extends well beyond reimbursement. Our attorneys have done complex litigation, ERISA, group health benefits, provider contracts, coverage disputes, procurement, rates, civil monetary penalties, and many aspects of Medicaid (acute and long-term care, developmental disabilities, and behavioral health), disabilities, civil rights, and class actions. We have experience in legislation and lobbying, rulemaking, licensing and administrative hearings. Gammage and Burnham attorneys also advise clients on a range of Medicare and Medicaid issues, including fraud and abuse and Stark compliance, antitrust, medical records, and professional and institutional licensing. We also provide general business representation to our health care clients, including assistance in the formation and operation of corporations, joint ventures and partnerships, medical office financing and leasing, employment related issues such as the enforceability of covenants not to compete and other employment restrictions, and intellectual property in the health care setting.
