Profile
John Dacey routinely advises clients on matters that concern health care, education, social services and disability issues. These include cases, for example, about Medicaid (AHCCCS), long-term care, the Division of Developmental Disabilities, behavioral health and insurance coverage. His civil litigation practice includes such cases as well as commercial disputes and class actions. His pro bono services emphasize services to the poor, people with disabilities and organizations that serve the homeless.

Mr. Dacey joined Gammage & Burnham in 1990 and is a partner of the Firm.

Recent Matters and Practice Areas:

• Serving as primary outside counsel to private schools, disability service providers and small human service agencies on all manner of legal issues, ranging from advice on daily matters to representation in complex cases;

• Representing families with autistic children to obtain specialized services;

• Representing service providers and beneficiaries in litigation to challenge cuts in programs for people with developmental disabilities;

• Representing Value Options in its bid protest against the Arizona Department of Health Services relating to Value Options’ loss of its $1.5 billion contract as the Regional Behavioral Health Agency for Maricopa County;

• Representing 20-plus Arizona hospitals in four separate trials in which the hospitals sought payment on 35,000 claims for services from Maricopa County. The trials resulted in judgments exceeding $47 million;

• Drafting legislation and appearing before the Arizona Legislature;

• Representing medical societies, practice groups and families in agency rulemaking and other administrative processes (including hundreds of grievances and appeals);

• Advising nonprofits on governance matters;

• Providing legal education and training to nonprofit boards and personnel, advocates and grassroots coalitions.
